Der Ausdruck Phänomenologie ist heute höchst vieldeutig geworden. Husserl hat seit 1905 eine immer stärkere Wendung zum Idealismus kantischer Prägung hin vollzogen, durch die er den Boden der Phänomenologie, wie er sie begründet hatte, verlassen hat. Eine ähnliche Abweichung von der ursprünglichen Idee der Phänomenologie findet sich bei vielen anderen "Phänomenologen." Die "realistische Phänomenologie", deren Vorläufer von Platon an und Klassiker von Husserl bis Schwarz in dieser ersten umfangreichen deutschsprachigen Anthologie zu Wort kommen, ist kein System, sondern eine Anwendung der (...) philosophischen Urmethoden, wie sie alle großen Philosophen tatsächlich anwandten, wenn sie ihre entscheidenden Entdeckungen machten. Mögen auch von Philosophen generell andere Methoden bewußt zugrunde gelegt werden, in dem Moment, in dem diese Einsichten gewonnen werden, liegt tatsächlich zu allen Zeiten jener letzte, fruchtbare Kontakt mit "den Sachen selbst" vor, der den Sinn der phänomenologischen Methode ausmacht, wie sie von den Meistern der realistischen Phänomenologie nur bewußter und systematischer angewandt wird als von vielen früheren Denkern. Nichts wäre darum irriger als in der phänomenologischen Betrachtungsweise eine Reduktion der Welt auf bloße "Phänomene" zu erblicken oder gar eine bloße Deskription der "Erscheinung" der Dinge. Zwischen phänomenologischer Betrachtungsweise und metaphysischer Wesensanalyse besteht kein Unterschied oder gar Gegensatz. (shrink)

Ce livre se propose de réaliser le projet ambitieux d'établir les fondements d'une épistémologie des nanotechnosciences. Il s'agit d'une analyse de philosophie des sciences portant sur cet objet nouveau et de grande importance scientifique, économique, politique et sociale. Cet ouvrage dresse un paysage détaillé des questions épistémologiques que posent les nanotechnosciences et cherche, chez les philosophes des sciences qui proposent des théories du changement scientifique, les moyens de répondre à ces questions. Compte tenu des conclusions de Guèye selon lesquelles aucune (...) des théories philosophiques actuelles ne répond vraiment aux questions épistémologiques soulevées par l'avènement des « nanotechnologies », il suggère quelques pistes pour dépasser les limites des épistémologies contemporaines, en s'appuyant sur la philosophie du langage d'Austin et sur la praxéologie de Denis Vernant. Dans cette contribution majeure au débat scientifique sur les nanotechnosciences, il procède à l'examen des principales théories philosophiques du changement scientifique dans le but de décider de leur capacité à prendre en charge les changements introduits par l'apparition des nouvelles technologies de « l'infiniment petit ». Ce projet philosophique tire son intérêt et sa pertinence du fait que l'apparition des « nanotechnologies » constitue un changement phénoménal, et qu'il est important de disposer d'une théorie du changement scientifique qui en rendît compte. Un autre thème majeur de ce livre est celui de la place de la recherche de la vérité dans les nanotechnosciences. Même s'il s'agit d'un thème trop vaste, Guèye l'affronte cependant sans détour dans ce livre. La problématique du rapport entre science et technologie y est abordée plus franchement. (shrink)

I argue that political activity needs philosophical insights in order to keep pace with some exigencies of the human person, and of the nature of the body of any human community. More specifically, I argue that some ethical and moral principles should be the genuine foundations of the performed acts emanating from the political leader. Drawing mainly from philosophy, I argue that the issue of political leadership is an expressive example in which we encounter the necessity of bringing ethics into (...) the sphere of politics, in order to provide the latter with strong, unshakable, and objective foundations. This also gives me an opportunity to rise against Machiavellianism and its correlates. (shrink)

Ethical Personalism proposes to reflect on the person from at least three levels: ontology, epistemology, and ethics. Articulating the ontological and inalienable value of the human person, i.e., her dignity, from various philosophical and religious angles and traditions, the contributors show not just what it means to be a human person, but also what it takes to live accordingly. Hence, beyond the purely theoretical elaboration on ethical personalism that reposes the crucial debates between relativism and realism on the one hand, (...) and consequentialism and deontology on the other, this volume offers a range of insights useful for addressing concrete and practical matters that we, as humans, are confronted by in our everyday life. Ce texte est une note critique autour de la difficulté à définir précisément ce qu’il faut entendre par nanosciences et nanotechnologies. Dans la première partie, nous faisons ressortir la multiplication des définitions, (...) liée aux luttes économiques, aux enjeux stratégiques et aux intérêts hétérogènes des acteurs. This chapter provides a historical account of the transformation of pregnancy through philosophical theory and legal practice. What has remained seemingly consistent across history, though, is the lack of rights a pregnant woman can enjoy. Whilst it may manifest differently across time and place, unfortunately misogynistic attitudes persist, and this is reflected in the continual degrading of the gestator (and gestation), which is reinforced by certain philosophical theorising and technological advancement. We thus urge caution in making philosophical claims about the (...) epistemic transformation in pregnancy, given the epistemic (and other) injustices already faced by pregnant people. We recognise that there are transformations that occur because of pregnancy, but we argue that there ought not be with respect to the pregnant person's autonomy, agency, and control over their bodies. Through an analysis of legal cases, we can see that the practice falls out of line with the theory regarding how pregnant people are treated. But perhaps it is both the theory and the practice that need to change so as to bring them in line. How we theorise about pregnancy is intertwined with our cultural views, our technological advancements, and our medical and legal practices, requiring multi-disciplinary study for a more holistic overview. In this chapter, we contribute to this endeavour by bringing some such strands together, regarding the transformation that pregnancy is, that pregnancy makes, and that pregnancy has had historically, in philosophy, and in legal practice. “Adam was hurled into Hindustan. In this land there is a mountain called Serandib, and it is reported that there is no higher mountain in all the universe. Adam landed on this mountain.” The subject of Serendib plays an important role in both the geographical and travel literature of the Arabs. Serendib, or Sarandib, is the transcription of the Singhalese name Sinhaladîpa, which means “island of the descendants of lions” (singha, “lions,” in Singhaly). Already, in the Middle Ages, in the (...) year 949, Arab merchants, who were well acquainted with the island of Ceylon, set up a branch in Colombo. The natural beauty and wealth of the island so touched the imagination of Arab voyagers that it appeared in the sixth voyage of Sinbad the Sailor, and it was also believed that Adam lived on the island after having been driven from Paradise: “The island of Serendib is located directly under the equinoctial line…. Men fish for pearls along its banks and at the mouths of its rivers, and some of its valleys are rich in diamonds. As an act of faith I myself took a trip to the mountain, to the very spot where Adam was banished after being exiled from Paradise. I even climbed to its summit.”This excerpt, from The Thousand and One Nights, well summarizes the feelings of those Arab merchants whose accounts of their travels, in large measure, contributed to the spread of myths and legends about Ceylon. It is now time for bioethics to take full account of the problems of health disparities and structural injustice that are made newly urgent by the COVID-19 pandemic and the effects of climate change. Churchill make the case for a more social understanding and application of justice, a deeper humility in assessing expertise in bioethics consulting, a broader and more relevant research agenda, and greater (...) appreciation of the profound health implications of global warming. In recent years, global corporations and national governments have been enacting a growing number of codes of conduct and public regulations to combat dangerous and degrading work conditions in global supply chains. At the receiving end of this activity, local producers must contend with multiple regulatory regimes, but it is unclear how these regimes interact and what results, if any, they produce. This article examines this dynamic in the sugar sector in Brazil. It finds that although private and public agents (...) rarely communicate, let alone coordinate with one another, they nevertheless reinforce each other’s actions. Public regulators use their legal powers to outlaw extreme forms of outsourcing. Private auditors use the trust they command as company insiders to instigate a process of workplace transformation that facilitates compliance. Together, their parallel actions block the low road and guide targeted firms to a higher road in which improved labor standards are not only possible but even desirable. (shrink)

From the late seventeenth century on the idea of culture underwent a gradual transformation. Originally this concept referred essentially to the “refined” way of life of the ruling social elite. Popular culture, on the other hand, refers to the usually collective practices of groups of rural and urban workers taking the form of performance. They were not only excluded from refined culture, but it was regarded as completely unsuitable for them, potentially creating dangerous social aspirations. It is with the great (...) social transformation from feudal to bourgeois society that the idea of refined culture was replaced by that of “high culture” encompassing both the arts and the sciences: works claiming universal human significance. This “high culture” for a considerable time coexisted with the remnants of popular culture. It has been only due to the great technical advances that its true opposite, “mass culture” emerged, at the turn to twentieth century, claiming an empirical universality: being understandable and truly interesting to everyone. In economic respect, there is a competitive relation between high and mass culture. However, it is argued that there can be no cultural competition between them. For they posit differing and potentially co-existing receptive attitudes. The characterisation of this difference and the discussion of the seeming exceptions to the so-articulated conceptual scheme occupies the concluding part of this essay. (shrink)

Under the assumption that anticipatory models are required for anticipatory behavior, an important question arises about the different manners in which organisms acquire anticipatory models. This article aims to articulate four different non-exhaustive ways that anticipatory models might possibly be acquired over both phylogenetic and ontogenetic timescales and explore the relationships among them. To articulate these different model-acquisition mechanisms, four schematics will be introduced, each of which represents a particular acquisition structure that can be used for the purposes of comparison, (...) analysis, and hypothesis formulation. By bringing to the fore the differences and similarities between each of the four ways that anticipatory models are acquired, a more complete picture of both anticipatory behavior and its pervasive role in biological self-maintenance can be offered. In doing so, this article helps not only to shed light on how anticipatory behavior might arise in the wide range of organisms that it has been observed in but also to throw into relief the subtle and often still overlooked causal interplay between ontogenetic and phylogenetic plasticity. Despite being a milestone in the history of statistical causal inference, Sewall Wright’s 1918 invention of path analysis did not receive much immediate attention from the statistical and scientific community. Through a careful historical analysis, this paper reveals some previously overlooked philosophical issues concerning the history of causal inference. Placing the invention of path analysis in a broader historical and intellectual context, I portray the scientific community’s initial lack of interest in the method as a natural consequence of relevant scientific (...) and philosophical conditions. In addition to Karl Pearson’s positivist refutation of causation, I contend that the acceptance of path analysis faced several other challenges, including the introduction of a new formalism, conceptual barriers to causal inference, and the lack of model-based statistical thinking. The presence of these challenges shows that the delayed progress in causal inference in the early twentieth century was inevitable. (shrink)

This book explores the main stages and key concepts in the development of Kant's critical philosophy, from the early 1760s to the 1790s. Karl Ameriks provides a detailed and concise account of the main ways in which the later critical works provide a plausible defense of the conception of humanity's fundamental end that Kant turned to after reading Rousseau in the 1760s. Separate essays are devoted to each of the three Critiques, as well as to earlier notes and lectures and (...) several of Kant's later writings on history and religion. A final section devotes three chapters to post-Kantian developments in German Romanticism, accounts of tragedy up through Nietzsche, and contemporary philosophy. The theme of an elliptical path is shown to be relevant to these writers as well as to many aspects of Kant's own life and work. The climb of Gasherbrum IV’s (7,925 m) ‘Shining Wall’ in 1985 by Voytek Kurtyka and Robert Schauer is considered one of the greatest mountaineering achievements in the twentieth century, even though the two climbers did not reach the summit. The article explores three ways of understanding mountaineering without the objective of reaching the summit. I start with a game-playing approach and then a view on mountaineering that takes its inspiration from deep ecology and argue that while both have the potential (...) for explaining important aspects of mountaineering, neither will fully account for the value of climbing mountains without summiting. Finally, I argue that we can supplement either of these two views with a radically different way of understanding mountaineering, which involves creating and appreciating a work of art. (shrink)

In this article, we suggest that one of the unexplored paths toward collaboration between firms and civil society organizations starts with confrontation or potential conflict, and that the transition toward collaboration can be further understood if one focuses on triadic relationships rather than dyadic ones. We analyze the presence of third parties and their different roles to explain how collaboration is facilitated. The article aims at bringing together the bodies of research on business–civil society confrontation and on business–civil society collaboration. (...) It offers a comparative analysis of four case studies, and proposes a typology of third parties composed of facilitating allies, participating allies, mediators, and solution seekers. The spin of a free electron is stable but its position is not. Recent quantum information research by G. Svetlichny, J. Tolar, and G. Chadzitaskos have shown that the Feynman position path integral can be mathematically defined as a product of incompatible states; that is, as a product of mutually unbiased bases (MUBs). Since the more common use of MUBs is in finite dimensional Hilbert spaces, this raises the question “what happens when spin path integrals are computed over products of (...) MUBs?” Such an assumption makes spin no longer stable. We show that the usual spin-1/2 is obtained in the long-time limit in three orthogonal solutions that we associate with the three elementary particle generations. We give applications to the masses of the elementary leptons. (shrink)

In this chapter, I discuss the possibility of using genome editing technologies in the context of assisted reproduction. I present the most prominent arguments in favour of and against this use of genome editing technologies, and explore two strategies used in bioethics in the event of moral disagreement to analyse the questions at hand and to develop morally sound policies. These strategies are: the clarification of the facts regarding a new technology and the formulation of the best philosophical argument. I (...) contend that both approaches are theoretically flawed and might result in states of affairs that fail to promote peoples’ well-being. I then argue that we should focus instead on finding at least some common ground in order to move forward in the debate on genome editing, building a regulatory framework that lightens “the burden of human existence”, whilst still accommodating opposing views as much as possible. Furthermore, I argue that insights from moral psychology and democratic governance can assist us in these challenges. (shrink)

Oliver Wendell Holmes, Jr. is, arguably, the most important American jurist of the twentieth century, and his essay The Path of the Law, first published in 1898, is the seminal work in American legal theory. In it, Holmes detailed his radical break with legal formalism and created the foundation for the leading contemporary schools of American legal thought. He was the dominant source of inspiration for the school of legal realism, and his insistence on a practical approach to law and (...) legal analysis laid the basis for the realists' later concentration upon the pragmatic and empirical aspects of law and legal procedures. This volume brings together some of the most distinguished legal scholars from the United States and Canada to examine competing understandings of The Path of the Law and its implications for contemporary American jurisprudence. The literature on indicative conditionals contains two appealing views. The first is the selectional view: on this view, conditionals operate by selecting a single possibility, which is used to evaluate the consequent. The second is the informational view: on this view, conditionals don’t express propositions, but rather impose constraints on information states of speakers. Both views are supported by strong arguments, but they are incompatible on their standard formulations. Hence it appears that we have to choose between mutually exclusive options. (...) But the options are not exclusive. This paper develops a theory of the semantics and assertability of conditionals that is both selectional and informational. The theory vindicates the signature inferences of both selectional and informational theories, including so-called Conditionals Excluded Middle and principles about the interplay between conditionals and ‘might’. It also predicts some interesting and puzzling facts about the assertion of conditionals. (shrink)
